That’s why we have a clear and straightforward Digital Millennium Copyright Act (DMCA) policy in place.

What is the DMCA Anyway?
In simple terms, the DMCA is a US law designed to protect copyright holders online. It gives content owners a way to ask websites to take down material that infringes on their copyrights. For us at ViralSensei, it means we have a process to address claims of copyright infringement quickly and fairly.

How to Report Copyright Infringement (It’s Easier Than You Think!)
If you’re a copyright owner or authorized to act on behalf of one, and you believe that content hosted on ViralSensei is infringing your copyright, please let us know. We’ve made the process as simple as possible:
Here’s what information we need from you to process your DMCA Notice:
To make sure we can act swiftly and accurately, please provide us with the following details when you send your DMCA takedown request:
- Identify the Copyrighted Work: Be clear about what copyrighted work you are claiming has been infringed. For example, if it’s an article, tell us the title, where it was originally published (if applicable), and any registration details (if you have them). If it’s an image, describe the image.
- Identify the Infringing Material: Tell us exactly where on ViralSensei the material you believe is infringing is located. This is super important! Please provide the URL (web address) of the specific page or post on ViralSensei where the infringing content is found. Just saying “the website” isn’t enough, we need the direct link.
- Your Contact Information: We need to be able to contact you (or your authorized agent) to follow up. Please provide:
- Your Name
- Your Address
- Your Telephone Number
- Your Email Address
- Statement of Good Faith Belief: Include a statement saying that you have a “good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.” You can say something like: “I have a good faith belief that the use of the copyrighted material described above is not authorized by the copyright owner, its agent, or the law.”
- Statement of Accuracy: Include a statement that “the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.” You can say something like: “I swear, under penalty of perjury, that the information in this notification is accurate and that I am the copyright owner, or authorized to act on behalf of the owner, of an exclusive right that is allegedly infringed.”
- Your Physical or Electronic Signature: Digitally sign your notice (if sending electronically) or provide your physical signature if sending a written notice.
Your DMCA Notice:
Once we receive a complete and valid DMCA notice, here’s what we’ll do:
- We’ll Review Quickly: We’ll promptly review your notice to ensure it meets the DMCA requirements.
- Potential Takedown: If we believe the notice is valid, we will remove or disable access to the content identified as infringing.
- Notification to the User: We will take reasonable steps to notify the user who posted the content so they are aware of the takedown and have the opportunity to respond if they believe it was removed in error (through a counter-notification process – explained below).
- Our Records: We will keep a record of all DMCA notices we receive.
What if You Think Your Content Was Removed by Mistake? (Counter-Notification)
We understand that sometimes mistakes happen. If you believe your content was removed from ViralSensei due to a DMCA notice in error, you have the right to send us a “counter-notification.”
To file a counter-notification, you’ll need to provide us with the following information:
- Your Identification: Your name, address, and telephone number.
- Identification of the Removed Material: Clearly identify the content that was removed and where it was located on ViralSensei before it was removed (provide the URL if possible).
- Statement Under Penalty of Perjury: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Consent to Jurisdiction: Your consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if your address is outside of the United States, for any judicial district in which we may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
- Your Physical or Electronic Signature: Digitally sign your counter-notification (if sending electronically) or provide your physical signature if sending a written notice.
What Happens After a Counter-Notification?
If we receive a valid counter-notification, we may forward it to the original complaining party. If the original copyright claimant does not file a court action seeking a restraining order to keep the material down within 10-14 business days of receiving the counter-notification, we may, at our discretion, reinstate the removed material.
Repeat Infringers
ViralSensei also has a policy in place to address repeat copyright infringers. In appropriate circumstances, we may terminate the accounts of users who are determined to be repeat infringers.
